JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272/273/308/34 of the Indian Penal Code and 47a of the Excise Act.
45 liters of liquor was recovered from the apprehended co-accused Ramesh Ram, who disclosed the name of the petitioner as the person, who escaped from the scene.
It is submitted by learned counsel for the petitioner that except the confession there is nothing against the petitioner. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation and the quantity of alleged recovery from the co-accused, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender
