JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-04-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Khagaria (Gangour) P.S. Case No. 403 of 2021, registered for the offence punishable under Section 498(A) of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The petitioner is the husband of the informant. He is in custody since 25.07.2021. It is alleged in the First Information Report that the informant was tortured variously for non-fulfillment of demand of dowry. On one day, allegedly, the in-laws of the informant had attempted to kill her. Learned counsel appearing on behalf of the petitioner has submitted that it is purely a matrimonial dispute

Patna High Court CR. MISC. No.63353 of 2021(2) dt.07-04-2022 2/2 between the petitioner and the informant, which has resulted into registration of a criminal case. The petitioner is willing to stay with the informant as husband and wife with full dignity. Be that as it may, considering the nature of allegation, submissions made on behalf of the petitioner, as noted above, and the fact that the petitioner is in custody since 25.07.2021, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Khagaria, in Khagaria (Gangour) P.S. Case No. 403 of 2021.
