JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, and 201/34 of the Indian Penal Code.

Petitioner and other F.I.R named accused are said to have been taken away the deceased from his house and, subsequently, the dead body of the deceased was recovered from a ditch.

Submission on behalf of the petitioner is that after recovery of dead body of the deceased, U.D. Case No. 36 of 2014 dated 23.10.2014 was registered and after that the present case was lodged on 27.10.2014.

Submission on behalf of the petitioner is that while recording the aforesaid U.D. case, the dead body was identified but neither informant nor any other person disclosed the story, as

Patna High Court Cr.Misc. No.42576 of 2016 (2) dt.06-10-2016 2/2 propounded in the fardbeyan of the informant. Moreover, having more or less similar allegation, one co-accused namely Rahul Sah has already been granted privilege of bail by a Co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Asutosh Kumar, Judicial Magistrate, 1st Class, Barh in connection with Salimpur P.S. Case No. 170 of 2014.
