Petitioner, who is in custody, seeks bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 184 of 2018 registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code.

Informant has alleged that her husband was called by co-accused Pankaj Yadav but did not accompanied him and thereafter four more co-accused including petitioner came and took her husband along with them. In the morning when she inquired where about of his husband Sadanand Yadav and Sahindra Yadav refused having any knowledge about where about of her husband. In the evening she came to know that dead body of one person was lying near the river which was covered by the mud

Patna High Court Cr.Misc. No.67899 of 2018(2) dt.27-11-2018 2/2 and it was found to the dead body of her husband. It has been submitted on behalf of the petitioner that he has been made accused on the basis of suspicion only and except suspicion there is nothing against him. It has been further submitted that similarly placed co-accused have been granted bail by another co-ordinate Bench of this Court enclosed as Annexure- 2 series in this petition. Petitioner has no criminal antecedent and he is in custody since 15.06.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Assistant Chief Judicial Magistrate, Bhagalpur in connection with Nathnagar (Madhusudanpur) P.S.
