JUSTICE ARUN KUMAR ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State The petitioner, who is in custody, seeks bail in connection with Kalyanpur P.S. Case No. 95 of 2015 registered for offence under Sections 341, 323, 307, 414 and 504 of the Indian Penal Code and Sections 25(1-b)a/26 of the Arms Act. Allegation in brief is that this petitioner alleged to have hit over the head of the informant with the butt of the pistol having no cartridges in it and thereafter he escaped away. Learned counsel appearing on behalf of the petitioner submits that allegation is false and fabricated. Even there is no allegation that he was shot by fire arm rather only allegation is that he hit with butt of the pistol and the injury report shows only a lacerated wound over left ear and one abrasion by the side of nose.

Patna High Court Cr.Misc. No.605 of 2017 (2) dt.11-01-2017 Injury no. 2 is simple in nature This petitioner has been in custody since 31.3.2016.

Considering the period of custody and in particular that there is no allegation of firing at the informant simply hitting with the butt of the pistol, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd, Samastipur in connection with Kalyanpur P.S. Case No. 95 of 2015, Sessions Trial No. 360 of 2016.
