JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Gogri P.S. Case No. 189 of 2018, registered for offences punishable under Sections 30(a) & 41(1) of Bihar Prohibition and Excise Act, 2016.

Allegation as per F.I.R. is that police on information that a Pickup Van loaded with foreign liquor is coming, on which police intercepted the Pickup Van and 906 liters foreign liquor was recovered from the said vehicle, but the petitioner and others were succeeded in fleeing away.

Submission of learned counsel for the petitioner is that the petitioner has not been arrested from the spot and he has named in the case only on the information given by the spy and the petitioner is in judicial custody since 01.09.2018 having no criminal antecedent.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd cum Special Judge (Excise) Khagaria, in connection with Gogri P.S.
