Petitioner is languishing in custody since 29.06.2016 in a case registered for the offences punishable under Sections 323, 341, 498A of the Indian Penal Code. The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that petitioner admits his marriage with the informant and birth of two children. The petitioner is still ready to keep the informant and children with full dignity and honour. Statement to that effect has been made in para-8 of the petition which reads as follows:- "That, petitioner, who is happens to be husband of the informant, has fully aware about his duty and responsibility and he always tried his best to resume his happy conjugal life and always assured the informant to give her

Patna High Court Cr.Misc. No.43569 of 2016 (2) dt.21-10-2016 all dignity, love & affection as a wife desire but she is not ready. In fact on the request and above mention plea, learned Sessions Judge, Madhepura issued notice to the informant she was appeared but not turn up to resume the conjugal life with the petitioner."

Moreover, investigation has already concluded.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Uda-Kishunganj, Madhepura in connection with Alamnagar P.S. Case No. 37 of 2016.
