This application is for grant of regular bail in connection with Bihta P.S.Case No.324of 2015 and Sessions Trial No.581 of 2015.for the offences under Sections 302, 387/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected thrice by the then Hon'ble Co-ordinate Bench of this Court, which will appear from Annexure-1 series and lastly rejected the prayer for bail and it was directed to expedite the trial and conclude the same as early as possible preferably within four months.

There is allegation of murder as well as extortion. Submission of the learned counsel for the petitioner is that up till now out of nine witnesses only three

Patna High Court Cr.Misc. No.70172 of 2018(2) dt.07-12-2018 2/2 witnesses have been examined. He is in custody for two years and there is no chance of conclusion of the trial in near future. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner , however, since the petitioner is in custody for two years, the learned trial court is directed to expedite the trial and conduct it on regular basis.

At the same time, the Sr. S.P., Patna is directed to ensure the presence of the evidnece in the cout so that the trial may eb concluded expeditiously.

With the aforesaid observation, this application is dismissed.
