JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 406, 420, 365, 379, 506/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. He submits that there is business term between son of petitioner and Sanjay Tiwary, who is Managing Director of U.T.S. INFRATEL and informant is its employee, as per letter of intent and several discussion on CCTNS project for 10 sites also as well as for ONORC project 19 sites have been allotted to the son of petitioner's company i.e. Urvershi Consulting Services, for which total security amount of Rs. 45 lacs have been deposited by son of the petitioner in favour of U.T.S. Infratel

Patna High Court CR. MISC. No.9525 of 2021(2) dt.13-07-2021 2/2 Pvt. Ltd. through different mode and dates. He submits that out of 45 lacs, 6 lacs rupees transferred to the account of informant through RTGS. There is no specific allegation against the petitioner. It is submitted that the petitioner is an old man of 71 years and he is the father of Satyam Shandilya. He further submits that petitioner is languishing in judicial custody since 11.10.2020.

Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khagaria (Mufassil) P.S.
