2. The petitioner has preferred this application for grant of regular bail in connection with Sessions Trial No. 110/2025 arising out of Muffasil P.S. Case No. 272/2024 dated 10.06.2024 registered for the offences punishable u/ss 302, 120B read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons came to the house of the informant and took away the son of the informant by calling him under conspiracy. Thereafter, at about 8 P.M., the informant received an information that his son was shot dead near Hardia Math.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged occurrence. The informant (P.W. 3) in his deposition has stated that he has not seen the petitioner with the deceased at the relevant time of the alleged occurrence. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.06.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. Earlier the regular bail of the petitioner was rejected by this court vide order dated 16.12.2024 passed in Cr. Misc. No. 65358 of 2024.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Motihari, East Champaran in connection with Sessions Trial No. 110/2025 arising out of Muffasil P.S. Case No. 272/2024, with the condition:- (i). The petitioner is directed to remain physically
