JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 452, 376, 302, 436/34 of the Indian Penal Code and Section 27 of the Arms Act. Earlier the prayer for bail of the petitioner was rejected by this court taking note of this fact that it was petitioner, who shot fire on the deceased and again I am not inclined to grant privilege of bail to petitioner on the above stated ground. Accordingly, the prayer for bail of the petitioner in connection with Sessions Trial No. 348 of 2015 arising out of Akbar Nagar P.S. Case No. 45 of 2013 pending in the court of 4th Additional Sessions Judge, Bhagalpur stands rejected.

No.50892 of 2016 (2) dt.07-12-2016 2/2 However, learned trial court should expedite the trial of the petitioner and try to conclude the same as early as possible because petitioner is in jail custody for more than two years. Copy of this order be sent to Superintendent of Police, Bhagalpur with direction to ensure the presence of prosecution witnesses of aforesaid case before the trial court without any delay, failing which the matter shall be viewed seriously.
