The petitioner is in custody since 25.05.2019 in connection with Manjhi P.S. Case No. 145 of 2019 for the offence registered under Sections 30(a), 56(B) of the Bihar Prohibition and Excise Act and Sections 2(e), 3, 5, 13 of the Bihar Mahua Flower Act.

Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner but from the pick-up van of which the petitioner was the driver.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing

Patna High Court CR. MISC. No.62395 of 2019(3) dt.17-10-2019 2/2 bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of XI Additional District and Sessions Judge, Saran at Chapra in connection with Manjhi P.S. Case No. 145 of 2019.
