JUSTICE ARUN KUMAR JHA ORAL ORDER 28-11-2024 Heard learned senior counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the respondents.

At the outset, learned senior counsel appearing on behalf of the petitioners submits that already an application under Order 7 Rule 11 of the Code of Civil Procedure, 1908 (hereinafter referred to as 'the Code') has been filed on behalf of the petitioners before the learned trial court bringing all the facts of the case, which has been placed before this Court, to the notice of the learned trial court. The learned senior counsel further submits that since the learned trial court is still to give

4/4 finding on the aforesaid application, the instant petition may be disposed of with direction to the learned trial court to dispose of the aforesaid application filed on behalf of the petitioners expeditiously.

In the light of submission made by the learned senior counsel appearing on behalf of the petitioners, the instant petition is disposed of with direction to the learned trial court to dispose of the application filed filed on behalf of the petitioners under Order 7 Rule 11 of the Code, expeditiously.
