ANJANA MISHRA ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Noorsarai P.S. Case No.19 of 2015 for allegedly having committed the offence under Sections 409, 420 and 120B of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is the Nazir of the concerned Block where flood reliefs are said to have been distributed. He further submits that the petitioner has no role to play in the payment save and except under the instructions for the higher authorities, he is bound to release the amounts mentioned in the vouchers which

Patna High Court Cr.Misc. No.32268 of 2015 (3) dt.03-11-2015 2/2 come down to him. He further submits that the Anchal Adhikari, who is also implicated in connection with the present case, has been extended the privilege of anticipatory bail by the court below itself.

Considering the aforementioned facts and circumstances and the role assigned to the petitioner and that he has no criminal antecedents, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda, in connection with Noorsarai P.S. Case No.19 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
