JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Haspura P.S. Case No. 56 of 2015 registered for the offence under Sections-341, 504, 323, 307/34 of the Indian Penal Code. There is case and counter case between the parties and both sides make allegation and counter allegation against each others.
No doubt, there is allegation against these petitioners that they assaulted the informant, his father and brother with sharp edged weapon as well as hard and blunt substance but
Patna High Court Cr.Misc. No.29388 of 2015 (2) dt.28-07-2015 2/2 Annexure-3 to this petition reveals that the informant sustained altogether four injuries, out of them; one injury has been found on his head but the said injury is simple while another injury is on his index finger and in respect of the same, opinion has been kept reserved. So far as other injuries are concerned; they are simple in nature.
Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of their arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioners named above, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Haspura P.S. Case No. 56 of 2015 to the satisfaction of Learned Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad subject to conditions as laid down u/S 438(2) of the Cr. P.C.
