Petitioner happens to be driver of the tempo from which in huge quantity, stolen wrist watch was recovered. Petitioner disclosed in his confessional statement before the police that the aforesaid stolen wrist watch had been handed over to him by co-accused Lal babu Mian, who along with one co-accused Tarjan managed to escape from the place of occurrence at the time of interception by the police. Petitioner does not have any criminal antecedent and is languishing in jail custody since 12.06.2016.
