Petitioner is languishing in custody since 15.07.2016 in connection with Kargahar P.S. Case No. 290/15 for offences punishable under Sections 341, 323, 504, 387, 34 of the Indian Penal Code.
The prosecution case is that the petitioner along with another co-accused stopped the bus of the informant, abused his driver and demanded Rs. 2,000/ as rangdari. It has been submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid case. He submits that the petitioner is the brother of the informant's driver and was asking for salary of his brother, as
Patna High Court Cr.Misc. No.45127 of 2016 (3) dt.26-11-2016 2/2 such, has falsely been dragged. He further submits that no specific allegation under Section 387 I.P.C. is made against him. However, learned APP for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, considering the nature of allegations and the period of custody, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas, in connection with Kargahar P.S.
