This application, for grant of anticipatory bail, arises out of Dhansoi P. S. Case No. 114 of 2016, disclosing offences under Sections 406, 409 and 420 of the Indian Penal Code.
The petitioner, at the relevant point of time, was working as Panchayat Secretary. It is alleged against him that he failed to make available to the Vigilance Investigation Bureau, the merit list, registers and folders relating to selection for appointment to the post of Panchayat Teachers of the Sikti Gram Panchayat.
It is submitted on behalf of the petitioner that despite the fact that the documents were made available by his predecessor, the petitioner has been made accused.
Learned counsel appearing on behalf of the State, on the other hand, has submitted that all the documents were not made available to the Vigilance Bureau, rather, part of them were made available after lodging of the First Information Report.
Considering the nature of accusation, this application is allowed. Let the petitioner above named in the event of his arrest/surrender within four weeks from today in the court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class-3, Buxar in connection with Dhansoi P.S. Case No. 114 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled. The provisional bail granted to the petitioner vide order, dated 28.10.2016, stands confirmed.
