JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-11-2018 The petitioner seeks regular bail in connection with Special Case No. 60 of 2018, arising out of Gandh Maidan P.S. Case No. 231 of 2018, registered for offences punishable under Sections 399 and 402 of the Indian Penal Code and sections 25(1-B)A, 26, 35 of the Arms Act and Section 27 of the NDPS Act.
Allegation against the petitioner is of recovery of one knife from the possession of the petitioner, when the police raided the place on information of preparation of dacoity by some persons and further from other accused persons, ganja and other arms and ammunition were recovered. It has been submitted on behalf of the petitioner that he has falsely been made accused in this case only on the basis of suspicion and except that there is nothing against the
Patna High Court Cr.Misc. No.67687 of 2018(2) dt.28-11-2018 2/2 petitioner and one of the co-accused has already been enlarged on bail by a coordinate Bench of this Court vide order dated 08.10.2018 passed in Cr. Misc. No. 61625 of 2018 and petitioner has been in judicial custody since 11.06.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned learned Sessions Judge/Special Judge, Patna, in connection with Special Case No. 60 of 2018, arising out of Gandh Maidan P.S. Case No. 231 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
