Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Barauni P.S. Case No. 385 of 2019, registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504 of the Indian Penal Code.
As per allegation, the accused persons named in the FIR came to purchase land of the informant and they badly assaulted the informant and his family members. There is specific allegation against the petitioner
Patna High Court CR. MISC. No.52480 of 2022(2) dt.23-01-2023 2/3 that he along with Md. Golden @ Imteyaz assaulted Md. Amin and Md. Firoz, who sustained cut injuries on their finger.
The learned counsel for the petitioner has submitted that there is admitted land dispute between the parties. The injuries are simple in nature and on similar footing, coaccused persons have been granted anticipatory bail by this Court vide Cr. Misc. No. 24708 of 2020.
On the other hand, the learned APP has opposed the prayer for bail. He has fairly admitted that the injuries suffered by Md. Firoz are simple in nature.
Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 385 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided hereinabove,
