The petitioner is apprehending arrest in a case registered for the offences punishable under section 47(a) of the Excise Act.
30 liters of country made liquor were recovered from the grocery shop of the petitioner.
It is submitted by the learned counsel for the petitioner that the recovery was not made in presence of the petitioner and more over, the shop in question is joint family property. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

No.32021 of 2015 (2) dt.06-08-2015 2/2 The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Excise Case No. 9 of 2010 pending in the court of learned JM Ist Class, Sadar at Motihari. This application is disposed of with the aforesaid observation/direction.
