The sole petitioner, who is in custody since 25.06.2016 in Goraul( Katahara O.P.) P.S. Case no.130 of 2016 registered for the offence under Sections 341, 342, 323, 324, 376/511, 307, 504, 354, 506, 379/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the informant side had entered into mango orchard of the petitioner and while they were apprehended, scuffle had taken place and, thereafter, a complete false allegation has been made and F.I.R. has been lodged.

Besides hearing learned counsel for the parties, I

Patna High Court Cr.Misc. No.46270 of 2016 (3) dt.25-10-2016 2/2 have also perused the material on record, particularly the F.I.R. and after going through the F.I.R. , at the moment, I am not inclined to extend the privilege of bail to the petitioner. The petition stands dismissed.
