JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Mashahari P.S. Case No. 23 of 2018, registered for offences punishable under Sections 304(B) and 34 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the husband of the deceased, is of dowry death of the deceased. Submission of learned counsel for the petitioner is that the petitioner was not present at the place of occurrence and father of the petitioner had informed the informant about the death of the deceased and thereafter this case has been lodged against the petitioner and others. Further the petitioner is in custody since 11.05.2018.

Heard learned A.P.P. also, who opposed the prayer for bail of the petitioner stating that petitioner is the husband of the

Patna High Court Cr.Misc. No.69291 of 2018(3) dt.20-12-2018 2/2 deceased and there is allegation of demand of dowry and the death is due to strangulation and there is nothing available in the diary to show that the petitioner was not present in the village. Having heard both sides, in view of the above facts, I am not inclined to grant bail to the petitioner. Accordingly, this application is dismissed.
