Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 423, 468, 471, 120B of the Indian Penal Code.

It is alleged against the petitioner that petitioner was a witness to the sale deed fraudulently executed by Yogendra Prasad and his sons.

It is submitted by learned counsel for the petitioner that thrust of accusation is against the executants of the sale deed. From the impugned order, it appears that petitioner never appeared. Hence, processes under Section 8283 Cr.P.C were directed to be issued but the same were set

Patna High Court Cr.Misc. No.33723 of 2015 (2) dt.13-08-2015 2/2 aside by the learned revisional Court with a direction to the petitioner to appear before learned Court below within a period of one month.

Considering the nature of accusation and the order passed by the revisional Court, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 2394(C) of 2002, pending in the Court of learned Judicial Magistrate, 1st Class, Patna. Accordingly the application is disposed of.
