The petitioners seek bail in a case registered under Sections 306/34 of the Indian Penal Code.
The prosecution case in brief is that the informant's daughter was administered poison by the accused persons which led to her death.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 27-02-2019. Charge sheet has already been submitted. The petitioners have
Patna High Court CR. MISC. No.49446 of 2019(2) dt.07-08-2019 2/2 been falsely implicated in the present case. There is no eye witness to the alleged occurrence. The deceased herself consumed poison, for which, the petitioner got treated her and in course of treatment, she died.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, the petitioners named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Supaul in connection with Triveniganj P.S.
