Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B), 201, 120(B) of the Indian Penal Code.

Petitioner happens to be husband of the deceased and admittedly, marriage of petitioner had taken place with deceased five to six years ago and after marriage, deceased gave birth to two children out of the aforesaid wedlock. It is alleged that petitioner and his other family members committed the murder of the deceased due to non fulfilment of illegal demand of dowry and

No.38872 of 2016 (3) dt.15-11-2016 2/2 they also disposed of dead body of the deceased without giving any information to the informant, who happens to be father of the deceased but in course of investigation at para 23 of the case diary, it came to light that one month prior to the alleged occurrence a quarrel had taken place between petitioner and his cousin brother, namely, Pappu Mishra, who passed sarcastic comments levelling allegation against character of the deceased which caused annoyance to the petitioner and after that the relation of deceased and petitioner became strained. Para-24 of the case diary goes to show that daughter of deceased made her statement before the investigating officer that her mother committed suicide locking the door from inside.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran, Motihari in connection with Turkaulia P.S. Case No. 573 of 2015.
