====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 20-12-2021 Heard learned counsel for the petitioners and learned A.P.P for the State.

The petitioners seek bail in Taraiya P.S. Case No. 294 of 2021, registered for the offence punishable punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. 70 litres of illicit liquor has been recovered from the house of Ganesh Sah petitioner no. 2.

It is submitted that no recovery has been made from conscious possession of these petitioners they have been falsely implicated in this case on the basis of suspicion. Recovery has been made from in front of the house of petitioner no. 2 and petitioners have got no concern with the seized liquor.

Patna High Court CR. MISC. No.62981 of 2021(2) dt.20-12-2021 2/2 Petitioners are in custody since 11.09.2021. Petitioner no. 1 has got clean antecedent. Investigation is complete. Learned APP however vehemently opposed the prayer for bail and submitted that petitioner no. 2 has got criminal antecedent of similar nature.

Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge Excise Act, Saran in connection with Taraiya P.S.
