Petitioner, who is in custody, seeks bail in connection with Kuchaikote P.S. Case No. 263 of 2018 registered for the offences punishable under Sections 30(A) (B) (C) , 38 and 41(a) (b) of the Bihar Prohibition and Excise Act, 2016.

Allegation against petitioner is of recovery of 362 liters and 880 ml. foreign wine from the seat and dicky of the car which was driven by the petitioner.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case. He has no concern with the alleged recovery and vehicle. He is not the owner of the said

Patna High Court Cr.Misc. No.66391 of 2018(2) dt.06-11-2018 2/2 vehicle. Driver fled away and he was arrested on suspicion that he is driver. He has no criminal antecedent. He is in custody since 02.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj in connection with Kuchaikote P.S. Case No. 263 of 2018.
