The petitioner seeks bail in Dandari P.S. Case No. 34 of 2016, registered for the offences punishable under Sections 467, 468, 420, 406 and 34 of the Indian Penal Code. The informant alleged that Shrawan Kumar got his wife insured in Reliance Insurance Company but he was not in a position to pay the premium. The informant requested Shrawan Kumar to get back the money from the insurance company on such the petitioner and Shrawan Mandal took his bond paper. Later on, the informant knew that Rs. 102794.06/- was withdrawn on the basis of fake death certificate of his wife by Shrawan Mandal.
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.43248 of 2016 (4) dt.15-12-2016 2/2 petitioner is not named in the FIR. The name of the petitioner figured in the case in the confessional statement of Shrawan Mandal but the petitioner did not put any signature on any paper nor withdrew the amount from the insurance company. The petitioner is alleged to have helped Shrawan Mandal in preparing the fake death certificate. The petitioner is in jail since 30.07.2016. Considering the facts aforesaid and the fact that the petitioner is in jail for about five months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, 3rd Begusarai in Dandari P.S.
