Mr.Raghwendra Kumar (Sc22) ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 30-07-2019 Heard learned counsel for the petitioner and the counsel appearing on behalf of the State.

Petitioner is aggrieved on the part of the inaction of the respondents in extending the benefit of resolution dated 7.12.2018 in the matter of pay fixation.

In the light decision of the Central Government, the Finance Department issued resolution dated 7.12.2018 and benefit of pay structure was extended to the employees. Learned counsel appearing on behalf of the petitioner

Patna High Court CWJC No.15325 of 2019(2) dt.30-07-2019 2/2 would submit that resolution dated 7.12.2018 was issued by the Finance Department for uniform application but unfortunately, the benefit in terms of resolution dated 7.12.2018 has not been extended to the petitioner.

Without going to the factual controversy, the writ petition is disposed of with direction to the respondents to consider the case of the petitioner in the light of the resolution dated 7.12.2018 and if it is found that the petitioner is entitled to the benefit under the resolution dated 7.12.2018, the same may be extended to the petitioner at the earliest, preferably within a period of sixty days from the date of receipt/production of a copyo f this order.

With the aforesaid, the writ petition stands disposed of.
