2. The petitioners apprehend their arrest in connection with Forest Case No. 43F of 2022 instituted under Sections 2, 9, 27, 29, 31, 39 & 51 of the Wild Life Protection Act.
3. As per the prosecution case, when the informant was on patrolling with his associates, he saw 10 to 15 persons going towards village with some materials on their shoulders and when the forest guards rushed to catch them, they fled away
Patna High Court CR. MISC. No.57946 of 2024(2) dt.11-09-2024 2/3 throwing the material which was identified as dead male "Cheetal" kept in the nylon net. Twelve accused persons have been identified.
4. Learned counsel for the petitioners submits that petitioners are innocent and have been falsely implicated in this case. He further submits that the petitioners are not named in the official complaint, however, their names appears in the seizure list. Learned counsel also submits that nothing has been recovered from the conscious possession of the petitioners and except the suspicion there is no material against the petitioners. The name of the petitioners has been dragged in this case because they are the resident of nearby village of the forest. He further submits that petitioners have no criminal antecedent and they undertake to co-operate in the investigation and the trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the
