The petitioners apprehend their arrest in Belaganj P.S. Case No. 295 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.
As per the prosecution case, all the FIR named accused persons including petitioners assaulted the informant and his family members, as a result of which informant, brother of informant and his son sustained injuries.
It is submitted that due to petty dispute the scuffle
Patna High Court CR. MISC. No.52289 of 2022(2) dt.19-12-2022 2/2 took place between the parties. There is case and counter case. Both sides sustained injuries. Allegation of assault is general and omnibus. Petitioners claim clean antecedents. Counsel for State however vehemently opposed the prayer for bail and submitted that out of three injured persons, two persons sustained grievous injury.
Considering the facts aforesaid and nature of injury, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
