The petitioner apprehends his arrest in connection with Mahila P.S. Case No. 15 of 2015 for the offence registered under Sections 498A, 406, 377/34 of the Indian Penal Code. A supplementary affidavit annexing the copy of the compromise petition as well as the Xerox copy of the Bank drafts amounting to Rs. 14,00000/-. has been filed on behalf of the petitioner, namely, Dr. Alok Agarwal @ Alok Agarwal. Today, the petitioner and the opposite party no.2 are present in person.
It is jointly submitted by the parties that an agreement
Patna High Court Cr.Misc. No.32133 of 2015 (6) dt.16-12-2015 has been arrived at between the parties to annul the marriage and they have entered upon a compromise. The terms of compromise has been incorporated in a compromise petition dated 16.12.2015. It is further submitted that four drafts amounting to Rs. 14 lacs have been prepared and handed over to the opposite party no. 2 which has been received by the opposite party no. 2 today. In view of the agreement arrived at between the parties and also taking note of the compromise petition, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna in connection with Mahila P.S. Case No. 15 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The compromise petition be kept on record and a copy of the same also be filed by the petitioner and the opposite party no. 2 in the Court below so as to facilitate further action. Jagdish/- (Anjana Mishra, J) U T
