The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. The learned counsel for the petitioner submits that police after investigation submitted charge-sheet under Sections 395 and 412 of the I.P.C.

The learned counsel for the petitioner submits that the petitioner is in custody since 24.12.2020, charges have been framed on 04.03.2022 and has antecedent of one case. The learned counsel for the petitioner further submits that the informant alleges that his driver informed that the pickup van, which was loaded with goods worth Rs.1,50,000/- was looted by four unknown criminals along with his mobile.

The name of this petitioner came in the confessional statement of co-accused Md. Bittu @ Sikandar Alam, who has been granted bail by order dated 22.02.2022 in Cr. Misc. No.55958 of 2021.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, charges have been framed and the co-accused, in whose confessional statement his name transpired, has been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hilsa P. S. Case No.631 of 2020, subject to condition that one of the bailors shall be the father of the petitioner namely, Niranjan Kumar.

The application stands allowed.
