This is third attempt on behalf of the petitioner, whose prayer was earlier refused on 06.11.2012 in Cr. Misc. No. 40591 of 2012 and, subsequently, on 15.05.2013 in Cr. Misc. No. 16780 of 2013. Perused the report of the trial court received through letter no. 219 dated 4th December 2014. It is now undisputed that only Investigating Officer and Doctor are left to be examined. In view of the above, I find no reason to change the view already taken vide order aforementioned. Accordingly, the prayer for regular bail of the abovenamed petitioner, in connection with Special Case No. 128 of 2012 arising out of Daniawan P.S. Case No.8 of 2012 pending before the 1st Additional District and Sessions Judge, Patna, is hereby refused.

Simultaneously, the trial court is directed to do all the endeavors to prove its expectation true and preferably conclude the trial within three months from the date of communication of the order. With the above observation, the application stands disposed of.
