JUSTICE SUDHIR SINGH ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.
Allegation is that some miscreants looted away Rs.36,860/- from informant which he had collected from medicine shops.
Earlier bail application of the petitioner was rejected vide Annexure-1 to the present application with an observation "at this stage". In light of said observation, this is the second attempt for bail on behalf of petitioner.
It has been submitted on behalf of petitioner that he is in custody since 16.2.2016. Chargesheet has been submitted against petitioner. There is no allegation of tampering of witnesses against petitioner. He is not named in the F.I.R. He has been made accused on the basis of confessional statement of the coaccused. There is no recovery of any looted article from the conscious possession of the petitioner.
On behalf of the State, it is submitted that name of petitioner has come in course of investigation.

No.48533 of 2016 (2) dt.07-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case no. 214 of 2015, G.R. no.2654 of 2015.
