For the Petitioner/s : Mr. Kritya Nand Jha, Adv. For the State : Suman Kri Singh, (APP) ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA PRAKASH ORAL ORDER 27-07-2015 Heard learned counsel for the Petitioner and the State.
The Petitioner seeks quashing of the order of nondischarge dated 27.5.2015 by which the Additional District and Sessions Judge, III, Buxar, has refused to discharge the Petitioner in Sessions Trial No. 218 of 2012 arising out of Buxar Nagar P.S. Case No. 284 of 2010.
It has been submitted that the occurrence took place on account of land dispute and the injury is not dangerous to life and, hence, the Petitioner should be exonerated from Prosecution. Since the grounds taken by the Petitioner can be no reason for discharge, the application stands dismissed. The Court below is directed to conclude the Trial expeditiously.
