Learned counsel for the petitioner seeks permission to withdraw the present application.
It transpires from the order that Rs.3000/- was awarded as maintenance per month from the date of order i.e. 09.12.2015. Today is 15.03.2023 i.e. to say total 7 years and three month (i.e. 87 months) have lapsed. The total arrears of award shall be 87 months x 3000 = 2,61,000/- rupees, which has to be paid by the petitioner to the Opposite Party No.2. Since the petitioner is seeking withdrawal, Court is granting permission to withdraw the application directing the
Patna High Court CR. REV. No.348 of 2017(5) dt.15-03-2023 2/2 trial Court to issue process immediately for realization of the arrears Rs. 2,61,000/- alongwith present arrears. Principal Judge, Family Court is directed to issue process under Form No. 18 and 19 of Schedule-2 of Cr.P.C., 1973. Court is free to exhaust other methods for recovery of the said amount.
