Petitioner, who is in custody, seeks bail in connection with Motipur P.S. Case No. 615 of 2018 registered for the offences punishable under Sections 376, 504 and 506 of the Indian Penal Code and under Section 4 and 6 of the Protection of Children from Sexual Offence Act. Allegation against petitioner is of committing rape upon the daughter of the informant.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case due to personal grudge. There is no eye witness of the said occurrence. Medical Board assess the

Patna High Court Cr.Misc. No.65818 of 2018(2) dt.20-11-2018 2/2 age of victim girl about 16 to 17 years. The medical report dose not support the allegation. He has no criminal antecedent. He is in custody since 19.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge POCSO Act cum 1st Additional Sessions Judge, Muzaffarpur in connection with Motipur P.S. Case No. 615 of 2018.
