The petitioners seek bail in anticipation of their arrest in connection with Biraul P. S. Case No. 180 of 2020, instituted for the offences under Sections 341, 323, 324, 325, 307, 354(B), 380, 147, 148 and 149 of the Indian Penal Code.
They have been named in the F.I.R. along with 14
Patna High Court CR. MISC. No.11141 of 2021(2) dt.22-02-2022 2/3 other accused persons with the allegation of assaulting the members of the prosecution party.
It has been submitted on behalf of the petitioners that from the accusation levelled in the F.I.R., it would become very obvious that there was a dispute with respect to throwing of garbage on the road by either of the parties. A counter version of the occurrence also has been lodged by petitioner no. 4 vide Biroul P.S. Case No. 181 of 2020.
The injuries suffered by the victims of the subject F.I.R. are reported to be simple in nature.
Regard being had to the afore-stated facts, the petitioners, above-named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Biraul, Darbhanga, in connection with Biraul P. S. Case No. 180 of 2020,
Patna High Court CR. MISC. No.11141 of 2021(2) dt.22-02-2022 3/3 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The application stands allowed.
