====================================================== CORAM: HONOURABLE MR. JUSTICE SHAILENDRA SINGH ORAL ORDER 15-06-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.
The petitioners apprehend their arrest in connection with Meenapur P.S. Case no. 209 of 2021 registered under sections 307, 379 and other allied section of the Indian Penal Code.
Learned counsel for the petitioners submits that both parties are agnates and two persons are said to be injured who sustained simple injury and in between the parties a dispute is
Patna High Court CR. MISC. No.63429 of 2021(2) dt.15-06-2022 2/2 with regard to drainage and the informant's side were aggressor and in between both sides, free fight took place and there is case and counter case between the parties.
Learned APP opposes the prayer for anticipatory bail. Having considered above submissions and injury reports of so-called injured persons which are annexure 3 series submitted by the petitioners which show simple injury on the persons of the said injured and as per above submissions in between both parties, there is case and counter case and genesis of the occurrence is said to be dispute of drainage, in my opinion, lenient view may be taken.
Let the above named petitioners, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Meenapur P.S. Case no. 209 of 2021 subject to condition as laid down under section 438(2) Cr.P.C.
