This is second attempt for grant of bail on behalf of the petitioner in connection with S.T. No. 540 of 2017 ( arising out of Bhagwanpur P.S. Case No. 123 of 2014 ) registered for the offence under Section 366(A), 120 (B), 34 of the Indian Penal Code, 1860. Earlier by order dated- 04.04.2018 vide Cr. Misc. No. 10900 of 2018 prayer for bail of the petitioner was rejected. Now learned counsel for the petitioner submits that there was no material against the petitioner and in the case charge has been framed under Section 304A and 366(A) of the
Patna High Court Cr.Misc. No.69417 of 2018(2) dt.30-11-2018 2/2 Indian Penal Code, 1860. He further accepts that after framing of charge two prosecution witnesses have already been examined.
Considering the nature of accusation as well as the fact that trial has commenced, there is no reason to consider the prayer for bail.
The prayer for bail stands dismissed. However, while dismissing it is necessary to observe that the learned trial court make take appropriate steps for early disposal of the case. (Rakesh Kumar, J) praful/- U T
