JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section392 of the Indian Penal Code. Petitioner is not named in the first information report and in course of investigation, he is said to have been caught with a motorcycle, which had been used in committing the alleged crime.
Submission on behalf of petitioner is that the said motorcycle belongs to one Bholu Kumar and as a matter of fact, the petitioner does not have any concern with the said motorcycle. No doubt, petitioner carries criminal antecedent of two cases but in the present case, he is in jail custody since 14-05-2016
Patna High Court Cr.Misc. No.44698 of 2016 (2) dt.17-10-2016 2/2 and uptill now, he has not been put on Test Identification Parade. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kadamkuam P.S. Case No. 201 of 2016 to the satisfaction of Sri Madhvendra Singh, learned Judicial MagistrateIst Class, Patna. (Hemant Kumar Srivastava, J) A.K.V./- U T
