====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 22-12-2021 The learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the offences alleged under Sections 143, 323, 379, 354, 504 and 506 of the Indian Penal Code, registered in connection with Chapra Muffasil P.S.Case No.383 of 2020.

As per the allegation, the accused persons assaulted the informant and co-accused Pankaj Singh torn the blouse of the mother of the informant.

The learned counsel for the petitioners has submitted that all the Sections are bailable, except Sections 354 and 379 of the IPC. Both the petitioners are ladies and, as such, there is no

Patna High Court CR. MISC. No.9086 of 2021(2) dt.22-12-2021 2/2 application of Section 354 of the IPC. It has further been submitted that there is also a counter case, which is earlier to the present case. It has also been submitted that the allegation of assault is only on co-accused Shailesh Kumar, who is not the petitioner.

Considering the above-mentioned facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each, to the satisfaction of learned A.C.J.M.- IXth, Saran at Chapra, in connection with Chapra Muffasil P.S.Case No. 383 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
