This appeal happens to be against the acquittal filed by the victim relating to offence punishable under Section 376 IPC which prescribes minimum sentence of 7 years which may extend to imprisonment for life.

That being so, instant appeal would be maintainable before the Division Bench and is, accordingly, ordered so. Appellant as well as office to proceed in terms thereof.
