JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-25(i-b)a/26/35/30 of the Arms Act.
Taking into consideration that the petitioner misused the privilege of bail for near about 15 years and due to conduct and non-cooperation of the petitioner, even charge could not be framed against him, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Anti P.S. Case No. 10 of 2000 stands rejected.
However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/production of copy of this order and if, trial of the
Patna High Court Cr.Misc. No.46980 of 2016 (2) dt.27-10-2016 2/2 petitioner is not concluded within the above-said period, the petitioner may renew his prayer for bail before the learned trial court itself.
