The petitioners apprehend their arrest in Kalyanpur P.S. Case No. 67 of 2014, registered for the offences punishable under Section 366(A) of the Indian Penal Code.
The informant is not an eye witness of the occurrence. He came to known that Mukesh Kumar and his family members kidnapped his minor daughter as his minor daughter had gone to take tution, but she did not return.
It is submitted that the victim solemnized marriage with Mukesh Kumar. The petitioner no. 1 is brother, petitioner no. 2 is mother of Mukesh Kumar and petitioner nos. 3 and 4 are covillagers.
Patna High Court Cr.Misc. No.14642 of 2015 (4) dt.03-07-2015 2/2 There appears that on account of love affairs, the victim was enticed by Mukesh Kumar and there is no specific allegation against the petitioners.
Considering the facts aforesaid, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in Kalyanpur P.S. Case No. 67 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
