JUSTICE SHAILENDRA SINGH ORAL ORDER 30-08-2025 Petitioner seeks regular bail in connection with Choutham P.S. Case No. 32 of 2024 dated 07.02.2024 registered for the offences punishable under Sections 302 and 120B read with Section 34 of the Indian Penal Code.

2. Heard Mr. Mrityunjay Kumar, learned counsel for the petitioner, Mr. Syed Ehteshamuddin, learned APP for the State and perused the FIR as well as the trial court's order.

3. Considering the custody period of the petitioner, the completion of investigation against him, and mainly petitioner's the pleas that there is no eyewitness or direct evidence of the commission of the alleged murder and the informant, who happens to be the elder brother of the deceased has merely raised suspicion against this petitioner on account of a monetary dispute, which had resulted in a scuffle that occurred

No.59801 of 2025(2) dt.30-08-2025 2/2 one week prior to the registration of the FIR, and also coupled with the privilege of bail having been granted to the co-accused persons, namely Kundan Tanti and Bishundeo Tanti @ Bishundeo Tanti, by the learned co-ordinate Benches of this Court vide orders dated 30.07.2025 and 12.08.2025 passed in Cr. Misc. Nos. 45239 of 2025 and 54571 of 2025 respectively, this Court is inclined to release the petitioner on bail. Accordingly, let the petitioner named-above be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Choutham P.S. Case No. 32 of 2024.
