JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 01-03-2016 Since there is no provision for re-evaluation, this Court is not willing to summon the answer book of the petitioner in any subject much less Physics to carry out that exercise. The Board has filed a counter affidavit. They have taken a stand that re-checking has been done and no change was found in the marks of Physics as well as Biology, therefore, any apprehension expressed on behalf of the petitioner's counsel that if comparison is made with regard to performance in other subjects visà-vis these two papers then obviously petitioner was expecting better
Patna High Court CWJC No.9988 of 2015 dt.01-03-2016 2 / 2 result cannot be used as a logic because it is an individual's performance in every paper by the candidate which makes the difference in evaluation or award of marks and not the perception. It is a misplaced kind of expectation and demand to make by the petitioner in the present writ application which this Court is not willing to allow.
Writ application is dismissed.
