2. The petitioner is in custody since 27.09.2016 in connection with Kahalgaon (Shivnarayanpur) P.S. Case No. 304 of 2016 for the offences alleged under Sections 272 and 273 of the Indian Penal Code and Section 47 of the Bihar Excise (Amendment) Act, 2016.
3. It is submitted that the petitioner has been falsely implicated in connection with alleged recovery of about 15 litres of country made liquor (Mahua) which is denied.
4. Having regard to the entirety of the facts and circumstances of the case as well as the period of custody having already suffered by the petitioner above named since 27.09.2016, let him be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Shivnarayanpur) P.S. Case No. 304 of 2016.
